These Terms of Service ("Terms") govern your use of TrueDay, a personal wellness journaling app developed by Garen Kunz ("we," "our," or "us"). By downloading or using TrueDay, you agree to these Terms.
1. License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use TrueDay on your Apple devices for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or reverse-engineer any part of the app.
2. Not Medical Advice
TrueDay is a self-reflection and journaling tool. Nothing in TrueDay constitutes medical, psychological, or clinical advice. TrueDay is not a substitute for professional mental health care, medical treatment, or crisis services. If you are experiencing a mental health emergency, please contact a qualified professional or call emergency services.
3. TrueDay Premium
TrueDay Premium is available as a one-time purchase through the App Store. Premium unlocks additional features including full history access, AI insight reports, unlimited categories, data export, and Health integration.
- All purchases are processed by Apple. Payment terms, refunds, and billing are governed by Apple's App Store terms.
- To request a refund, visit reportaproblem.apple.com.
- If you previously purchased Premium, you can restore access at any time via Settings → Premium → Restore Purchase.
4. User Content
You retain full ownership of all content you enter into TrueDay — your ratings, categories, and notes. We do not claim any rights to your personal data. When you use the AI Insights feature, anonymized summaries of your data are processed by OpenAI to generate a report; no data is retained by our servers beyond the duration of that request.
5. Acceptable Use
You agree not to use TrueDay to:
- Violate any applicable laws or regulations
- Attempt to reverse-engineer, modify, or tamper with the app or its backend services
- Abuse the AI Insights feature to send content unrelated to personal wellness journaling
- Circumvent premium access controls or purchase verification
6. Data and Backup
TrueDay stores your data locally on your device. We strongly recommend using the Backup feature (Settings → Data → Backup as JSON) to protect your data. We are not responsible for data loss resulting from device failure, accidental deletion, or app removal.
7. Third-Party Services
TrueDay integrates with the following third-party services:
- Apple iCloud — optional sync, governed by Apple's terms
- Apple HealthKit — optional health data, governed by Apple's terms
- RevenueCat — purchase management, governed by RevenueCat's terms
- OpenAI — AI narrative generation via our proxy, governed by OpenAI's terms
We are not responsible for the practices or content of these third-party services.
8. Disclaimer of Warranties
TrueDay is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the app will be error-free, uninterrupted, or free of bugs. Your use is at your own risk.
9. Limitation of Liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of TrueDay, even if we have been advised of the possibility of such damages.
10. Termination
You may stop using TrueDay at any time by deleting the app. We may suspend or discontinue TrueDay at any time. If the app is discontinued, no refunds will be issued for one-time purchases already made.
11. Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions.
12. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Continued use of TrueDay after an update constitutes acceptance of the revised Terms.
